Marking The Street and Road Network with Red Lines in the Master Plan: Proposals for Improving Urban Planning Legislation

Abstract

The article substantiates the thesis that the street and road network should be considered not as one of the equalorder elements of the planning structure, but as its spatial and functional framework, which predetermines the configuration, connectivity and transport accessibility of other elements. On the basis of a systematic interpretation of urban planning, land and subordinate regulation, a discrepancy between the actual urban planning role of the street and road network and its current regulatory status is revealed. Unlike other elements of the planning structure, the street and road network has the properties of continuity, connectivity, hierarchy and infrastructural primacy, which requires its special regulatory isolation. A doctrinal model of fixing the red lines of the street and road network to be established in the master plan is proposed as a tool for early spatial reservation of public areas. The scientific novelty of the article lies in the development of an interdisciplinary approach that combines the legal construction of red lines with the urban planning categories of the morphology of the street network, transport connectivity and the spatial framework of settlement. The practical significance of the work lies in the formulation of proposals for amending the Urban Planning Code of the Russian Federation, aimed at increasing the consistency of territorial planning, urban zoning and documentation on the planning of the territory, as well as at reducing conflicts related to the definition of public areas and the reservation of land for the development of the street and road network.
